Insurance Related Cases in Massachusetts
Cannon v. Cannon, 69 Mass. App. Ct. 414 (2007): While hospitalized and dying, the husband sought to change the beneficiary to his life insurance policy from his wife, whom he was currently engaged in divorce proceedings with, to his children. This was prohibited due to the divorce proceedings, therefore the husband sought permission of the court. The children’s names were added with the wife to the policy as beneficiaries. When the husband died, the wife collected the full value of the policy and refused to pay the children anything. The children filed suit and the court ruled that the wife had received consideration for allowing the children to be added to the policy, which was sufficient basis for an estoppels claim by the children. The case was remanded for further determination.
